Running an affordable housing project in India? Then you already know the paperwork never really ends.
But here is one form most developers miss until it is too late — Form 18 under the Income Tax Act 2025.
Before your project can claim any tax benefit under Section 46(11)(d)(vii), the Central Board of Direct Taxes has to officially recognize it as a "specified business." That recognition does not happen automatically. You have to apply for it. And that application is Form 18.
This guide covers the full process - what the form is, who files it, how to file it, what CBDT does after you submit it, and answers to questions that come up most often.
Form 18 is a formal application filed before the Member (IT), CBDT to get your affordable housing project notified as a specified business under Section 46(11)(d)(vii) of the Income Tax Act 2025.
The filing rules are set out under Rule 36 of the Income Tax Rules 2026.
Why does this matter? Because without this notification, your project does not qualify as a "specified business" under the Act. That means no deductions, no tax benefits, even if your project otherwise meets every other requirement.
Any entity planning an affordable housing project and wanting CBDT notification under Section 46(11)(d)(vii) needs to file this form. That covers private limited companies, LLPs, partnership firms, and other registered legal entities.
One thing to note the form is filed under PAN login on the income tax e-filing portal. Not TAN login. Just PAN.
There is no fixed due date.
Form 18 is event-based, which means you file it when your project is ready and you want the notification. You are not locked into a particular month or quarter. Any time during the tax year works.
The entire process is online. No physical submission, no paper forms.
Here is exactly where to go on the portal:
Step 1 — Log in using your PAN credentials at the income tax e-filing portal.
Step 2 — Go to your Dashboard.
Step 3 — Click on e-File in the top menu.
Step 4 — Select Income Tax Forms.
Step 5 — Click on File Income Tax Forms.
Step 6 — Choose Forms as per Income Tax Act 2025.
Step 7 — Select Form 18, fill in all required details, and submit after verification.
Full navigation path: Dashboard → e-File → Income Tax Forms → File Income Tax Forms → Forms as per Income Tax Act 2025 → Form 18
Two options are available:
DSC (Digital Signature Certificate) — Works well if your entity already uses a registered DSC for income tax filings.
EVC (Electronic Verification Code) — Generated via Aadhaar OTP, net banking, or bank account verification.
Both are accepted. Use whichever you have ready.
Once the form is submitted, here is how the process moves forward:
Confirmation first — You get an SMS and email on your registered contact details right after successful submission.
CBDT review — The Board reviews the application. If anything is missing or unclear, they send a deficiency letter asking for more information.
Responding to deficiency — If you get a deficiency letter, you have one month from the end of that month to respond. So if the letter arrives on 12th August, you have until 30th September to reply.
Final decision — CBDT either issues an official notification in the Government Gazette, approving your project as a specified business, or rejects the application. Before any rejection, you get a chance to present your case.
Yes, it can.
Even after the notification is issued, CBDT has the authority to withdraw it under Rule 36(2)(g), 36(2)(h), 36(2)(i), and Rule 36(2)(j) of the Income Tax Rules 2026.
This usually happens when a project stops meeting the conditions it was approved under. So maintaining compliance even after notification is not optional — it is necessary.
